Shifting charges in society in India are the fees collected by cooperative housing societies whenever a resident or tenant relocates in or out. They are frequently referred to as move-in/move-out costs, logistical fees, or relocation expenses.

Why are They Charged & is it Legal in India? 

  1. Societies claim these fees cover administrative work, record updates, security arrangements, and lift maintenance during shifting. 

  2. There is no clear legal provision in many state cooperative laws that specifically permits shifting charges. 

  3. Societies can frame by-laws, but they cannot levy fees beyond what is allowed under the law or approved by the Registrar of Cooperative Societies (RCS). 

  4. Courts, including the Bombay High Court, have ruled that societies cannot impose arbitrary or excessive charges. Consumer courts have also treated unreasonable fees as unfair trade practices.

  5. You may submit a complaint to the Registrar of Cooperative Societies. You can also file a complaint with the consumer forum according to the Consumer Protection Act, 2019. If you pay under protest, you may initiate a civil lawsuit to recover the funds.

The shifting charges in a society can apply to both owners and tenants. This rule can vary from one society to another. A lot of societies levy this fee only to tenants at the time of move-in and not the owners. 


Are Shifting Charges Legal in India?


The answer to this question is not straightforward. Some state cooperative laws and model bylaws don’t explicitly recognise these charges. The shifting fee, unless expressly authorised by law, raises questions around enforceability and proper reasoning. There are a lot of other things around this subject, but still, the sifting charges remain a common practice in India.
