Section 9 of Transfer of Property Act, 1882 talks about the Oral transfer. A transfer of property may be made without writing in every case in which a writing is not expressly required by law.

In the section dictating

oral transfer of property

, it is mandated that a transfer of property may be made without writing in every case in which writing is not expressly required by law but it is also essential to note here that the act is not exhaustive of such kinds of transfers.

Now draft your sale agreement with the help of experts at NoBroker without any hassle. Got any legal issues? Get them resolved by legal experts here

It is also necessary to note here that

Section 9

of Transfer of Property Act would not apply to a case of transfer of immovable property made at the time of marriage by a Hindu.

It is essential to note here that the Transfer of Property Act clearly recognizes oral transfer in property law. However, an oral transfer of property is a rule unless there is a law which expressly requires that the transfer should be in writing.

I hope you have better understanding of oral transfer of property under section 9 of TPA now.
