A legal heir is an individual who has the and entitlement to succeed to the property and wealth of a deceased individual. The transfer is made either through a will or according to personal succession law.
Legal heirs can be categorized into two categories:
Class I heirs
Class II heirs
As per the Hindu succession law, if a Hindu man leaves behind property without a Will, it will be passed on to Class I heirs (the mother, children, and widow) in equal shares. In case there are not any Class I heirs, the property can be claimed by the Class II heirs (sister, brother, father, grandchildren, great grandchildren, and other relatives).
If the owner is a Hindu woman, then her children and husband get the property in equal proportion. If they are not present, then the property will go to her husband’s heirs. Failing that, it’ll go to her parents.
