What is deferred dower in Muslim law?

What is dower under muslim law?

In the absence of a will, a widow was entitled to a part of her husband's wealth by common law. The woman was able to support her and any babies born during the marriage thanks to the dower clause. A type of debt owed to the wife is called dower money. Dower is the amount of funds that the bridegroom commits to give as payment for the marriage. It resembles a sign of respect for the bride. Women have the entire right to dower, and how they exercise that right is up to them. Either the parties will agree to pay it, or the law will require payment.

What is the dower act objective?

The primary goal of the dower is to support the wife financially after a divorce or in the event of their husband's passing.

What does dower mean : Classification Of Dower

Dower can be classified into the following categories:
  • Specified Dower: Specified Dower is the term used when the sum of Dower is determined upon at the time of marriage. Sometimes before or after the marriage ceremony, it might be resolved. The guardian may fix the amount of Dower on account of the minor if the bride and the groom are minors.
  • Prompt Dower: The husband gives the wife this Dower as soon as she requests it after the marriage. If the spouse does not provide the wife the amount due, she may reject to be married to him.
  • Deferred Dower: If the couple divorces or the husband passes away, the wife receives the deferred dower. Providing this Dower is done to support the wife after the spouse has passed away.
  • Customary Dower:Under the contract when the amount of dower is not fixed at the time of marriage then it is called proper dower. The amount of dower settled upon the female members of the father’s family such as her father’s sister.

Difference between Shia and Sunni Law in Dower Act

Shia law Sunni Law

Proper dower can’t surpass 500 dirhams There is no Proper dower limit.
If the marriage is not consummated, no dower is payable under Shia law. If the wedding was not legally consummated, proper dower will be owed.
