My brother is a UPSC aspirant. I was once going through his books and came across the De Facto and De Jure meaning. If you are also preparing for civil service exams and want to know the same, I can share my insights with you all.
- Defacto:
The acknowledgement that is founded on "a fact" is referred to as "de facto'' recognition. Although these facts were first used in law or governance, the law does not formally acknowledge them. De facto practices are widespread but not recognised by law. De facto strategies are valid, but they are not covered by the law.
- Dejure:
De jure is a Latin term that refers to concepts like legitimacy, legality, and compliance with the law. It is impossible to dispute the legality and permanence of De jure recognition. Not only is it true, but it is also permitted by law. Under De Jure, state succession laws are applied. At the time the state accepts De Jure recognition, there is only one government present.
After understanding what does de jure and de facto mean, let us focus on the difference between them;
De Facto | De Jure |
De Facto refers to factual recognition. |
De Jure refers to legal recognition |
De Facto is transient. Contrary to De Jure, it is not perpetual. It is a transient and tentative recognition that can be revoked. |
De Jure, which is a legal acknowledgment, is an irrevocable, perpetual recognition. |
De facto succession laws do not apply. |
State succession laws are used under De Jure. |
A state asset or public debt cannot be recovered by the De Facto Government. |
State property or public debt can only be recouped by a de jure government. |
There will be two competing governments in the State that gains de facto recognition. |
A state that is granted De Jure status has a single government. |
