The term appurtenance generally applies to permanent property rights or items that are passed along with the sale of the property. An appurtenance is a real property defined as fixed or immovable to the ground. In this case, the appurtenance relates to the land. Now you know the land appurtenant meaning.

An appurtenance assigns possession of such things to the property owner while making legal transactions. For instance, if a house owner installs a water tank inside the house, they generally can’t remove it because it’ll be considered the property’s part.

Now you know what is appurtenance in real estate.

If you still don’t understand what makes something appurtenant, then let me tell you about some requirements that something is required to fulfill to be considered an appurtenance.

Criteria: Removal:

Something is considered an appurtenance if the removal of the addition or improvement would cause great damage to the house.

Permanence:

When an improvement is made to a house, it needs to be a permanent addition. It is applicable to any addition like a swimming pool or a heating system.

Method of Attachment:

Improvements need to be made using methods that are considered permanent. For example, installing a swimming pool that is above the ground versus an in-ground one. The installation of the former may be considered temporary and not part of the house.
