  • If the tenant remains in the property and the landlord accepts rent after the lease expires, courts generally treat this as an implied month-to-month (periodic) tenancy under Section 116 of the Transfer of Property Act (TP Act).

  • The original fixed-term agreement no longer applies, but the tenant still has rights until proper notice is given.

What Happens if a Tenant Overstays After the Agreement Expires?

In most cases, for a month-to-month tenancy, Section 106 of the TP Act requires at least a 15-day written notice to terminate the tenancy. Notices shorter than 15 days are often invalid, as recent Indian court rulings reaffirm.

  • If the original rent agreement specifies a different notice period, the landlord must follow that term. After issuing notice, if the tenant still refuses to vacate, the landlord can file for eviction in court or before the Rent Authority/tribunal.

  • The tenant may be liable to pay rent (or “holding over” rent) for the period they occupy the property after the lease expires. If the tenant stays without the landlord’s consent, the landlord can seek official eviction orders, damages or compensation, and in some cases higher market rent for the overstay period.

  • The tenant cannot legally be evicted immediately without proper notice and legal proceedings. Forceful removal is prohibited.

Both landlords and tenants should clearly document lease expiry, notices, and intentions to avoid disputes and lengthy legal processes. Maintain a record of all notices and communications regarding agreement expiration. Hope this answers your questions.
