I’m sorry for your loss. Since your brother has passed away, the legal heirs including you and your mother have equal rights over the property if he died intestate (without making a will). If he had made a will making your brother the beneficiary of the property, you would have had no legal right over the said property. However, since your brother has passed away, and if he was married, his wife and children will also be considered as legal heirs.
