Notarisation is done before registration to verify identities and signatures. It does not replace legal registration but adds authenticity. Here is what are the documents required for registration from notary to sale deed:

  1. Sale Agreement (agreement to sell)

  2. Power of Attorney (if someone signs on behalf of buyer/seller)

  3. Affidavits related to property rights

  4. Lease or rent agreements (if related)

Note: Registered sale deeds themselves do not require notarisation.

What are the Required Documents for Registration from Notary to Sale Deed?

To register a sale deed with the Sub-Registrar Office (which legally transfers ownership), you need the following:

A. Core Sale Deed Documents

  1. Draft Sale Deed / Sale Deed document on non-judicial stamp paper (signed)

  2. Original Title Documents (previous sale deeds / Mother Deed)

  3. Sale Agreement copy (if previously executed)

  4. Encumbrance Certificate (EC) — shows the property is free of legal dues

  5. Approved Building Plan / Layout plan

  6. Possession Letter / Allotment Letter (for flats)

  7. Completion / Occupancy Certificate (if applicable)

  8. Power of Attorney (registered POA if signing through agent)

  9. Joint development or land sharing agreement (for plots under projects)

B. Identity and Tax Documents

  1. Identity proofs of buyer and seller (Aadhaar, PAN, Passport, Voter ID)

  2. Address proofs (utility bill, passport, driving licence, etc.)

  3. PAN Cards (mandatory if value > Rs10 lakh)

  4. Passport-size photographs of buyer, seller, and witnesses

  5. Proof of payment of sale consideration (bank receipts)

  6. Property tax receipts / NOC from society or authority

C. Registration Essentials

  1. Proof of Stamp Duty payment (paid before registration)

  2. Registration Fee receipt

  3. Witness ID proofs (2 witnesses must sign at registrar)

  4. TDS certificate (if applicable, for high-value deals)
