As a legal student, I must tell you that the redevelopment process in Mumbai under the Pagdi system is complex. It includes the following steps.

  • Verify whether the property is chawl-eligible or a non-cessed pagdi property. 

  • Now, check ownership rights and title. Also, check for MHADA ownership, if any. 

  • Do examine the rent receipts, CTS extract, and property card. 

  • Look for any property-related problems or legal encumbrances. 

  • Call a special general meeting to go over and approve the proposed redevelopment plan. 

  • A majority of members (often 70% or more) must approve the plan and sign the required consent documents. 

  • Invite tenders from reputable developers. Based on the following, choose them. 

    • Experience and past projects. 

    • Financial capability. 

    • Project timeline and offers. 

    • Proposed redevelopment plan.

  • With the consent of the majority, finalise the developer through a general body meeting. 

  • Establish a committee to supervise the redevelopment process and serve as a mediator between the developer and the community.

  • Now, draft an MOU (Memorandum of Understanding) and sign the agreement.

  • Also, draft a conveyance deed for property ownership transfer.

  • The individual has to temporarily leave society. 

  • The developer can now proceed with demolition and constructing new structures following the authorized plan. 

  • Finally, the new apartments are returned to the society members with a Completion Certificate (CC) after the building is finished.
