In my society, we strictly follow the car parking allotment rules to ensure fairness and discipline. These rules, guided by the society’s bylaws and supported by RERA regulations, help maintain order and prevent conflicts among residents. Every housing society has its own parking guidelines that homeowners are expected to follow, ensuring smooth management and equal access to parking spaces for all.

What are the Rules for Parking in Residential Areas in India?

  1. In our society, each resident is given a fixed parking slot according to the approved layout plan, and random parking in other areas is not allowed.

  2. Families who own more than one car can apply for an extra parking space, which is allotted only if available and may come with additional charges.

  3. No one is permitted to park in front of other flats, block common areas, or obstruct emergency exits.

I hope this answer helps you get a clear idea.

The parking lot is owned by the housing society and is a common amenity under the Real Estate (Regulation and Development) or the RERA Act. In a housing society, there are now certain car parking allotment rules you must follow. There are stringent parking regulations in the housing society, where my brother lives. Let me share the parking regulations I know.

What are the Allotment Rules for Car Parking?

Various laws govern car parking allotment in India, including the RERA, 2016, Model Building Bye-Laws, and state apartment ownership acts. Here are the parking types allocated in housing societies.

  1. Stilt Parking: Covered parking beneath the building, usually allotted to residents.

  2. Open Parking: Common area parking, which cannot be sold by the builder.

  3. Basement Parking: Usually designated for residents, visitors, and commercial establishments.

Builders cannot sell open parking spaces separately as per RERA Section 2(n). These are common areas. The builder may allot covered and stilt parking, but must include it in the apartments cost.

  1. Housing societies can allocate parking slots based on availability but cannot charge separately for open parking spaces.

  2. Parking spaces should be allocated fairly, ensuring all residents get a chance. In case of limited parking slots, societies can allot them rotationally or through a lottery system.

  3. No resident can claim more than one parking spot per apartment unless extra spaces are available. Residents must designate separately and not occupy visitors\' parking.

I hope you found this helpful.

The parking allotment is an administrative function under each housing society’s managing committee. The MC (RWA) or General Body has the right to allocate parking slots to the registered residents. Registered residents include homeowners, their families and associate members. A builder has to provide a certain number of parking spaces based on the number of units of houses. According to the National Building Code, one car parking space must not be less than 13.75 sq. meter. For a 2-wheeler, it must not be less than 1.25 sq. meter.
