Hello. I can tell you what to do in such a situation. You first need to inform the upper flat owner, who is responsible for water leak from flat above. If possible, you can get into a mutual agreement to get the repairs done. 

Who is Responsible for Leakage in Flat Above?

It is the upper floor owner's responsibility to maintain their home to prevent water leakage. You can give a legal notice to the upper flat owner if there is no scope of mutual agreement. 

The builder is responsible for conducting leakage repair only up to a certain period since the time the society has been formed. If you live in a builder’s society or community, see whether the builder is a government-approved contract or a private builder. 

If the builder is a government-registered one, you can hand them a notice to highlight the issue and poor build quality. If this fails, you can give a copy of the same to the concerned department with information regarding the builder’s conduct. Also, send a copy to the police station.

If it is a cooperative society, you can write a complaint to the secretary or MC, including all the details after the builder handover.
