When property is transferred, but the transferee fails to submit membership papers or pay maintenance bills, here is what you can do:

  • Send a formal notification asking the transferee to pay the unpaid maintenance and provide ownership documentation.

  • To document the non-compliance, you can also notify the housing society about the same.

  •  The society can initiate legal action to recover the outstanding dues. They can file a suit against both the transferor (initially) and, after attempting to regularize the transferee's membership, against the transferee.

  • In extreme case, the society could refuse services (like parking, access to common amenities) to the property, provided such action is permitted by bylaws.
