My mother and I along with my father are joint owners for a flat. My mother passed away recently. My mother has not written who should inherit her share. No tenancy of arrangement is there. My question is as my father and I are alive should we register it again on our names.. 2. I have not taken possession as I live at a different place.. 3.My brother who has a family but due to his marital problem started living with my parents for 2 years now. How should I tell him to leave and what should I do .

Hi Raju,

After the demise of one owner, it is said that 50% share will go to the other owner and the remaining 50% share will be distributed among the legal heirs of the owner who has expired. 

In this case, you and your father, along with your brother are the legal heirs of your mother.

Therefore, it would be advised to decide mutually for the distribution of the share as you cannot ask your brother to leave who is also a legal heir of her mother.
