If your father purchased land through an Agreement of Sale in 1983 and has been in continuous, peaceful, and uninterrupted possession while cultivating it, he may have strong possessory rights under Indian law. Though an Agreement of Sale alone does not transfer ownership, long possession plus part-performance under Section 53A of the Transfer of Property Act can protect you from being dispossessed.
Your family may also claim ownership through adverse possession if possession has been open and hostile for over 12 years. However, proper title can be secured only by executing and registering a sale deed through legal proceedings if required.
