Now that we know what is RTI let us understand does cooperative housing society comes under RTI.
There is great confusion regarding the question if a cooperative society is a part of RTI act or not.
Is RTI applicable for cooperative housing societies?
The answer would be no! Let me tell you why.
At the beginning of my write-up, I mentioned RTI helps to secure citizens’ information under the RTI Act. But cooperative society is not a public authority therefore it does not fall under the RTI Act.
Since the cooperative society is not an institution of self-government established or constituted under the Constitution, by law made by the Parliament, by law made by the State Legislature or by way of a notification issued or made by the appropriate government therefore the cooperative societies cannot be a part of public authority.
Although there can be exceptions if:
A body owned, controlled or substantially financed by the government.
Non-governmental organisations funded by the Government.
Although the matter is complicated, residential and commercial cooperative societies do not follow. Also, Tamil Nadu condemned cooperative societies to follow RTI act. I hope this answers your question:
