An NRI can apply for Aadhaar only if they want to and if they have a valid Indian passport. Many NRIs do not need it because the Aadhaar rules mainly apply to people who live in India for a long time.
First, the law says that only a “resident” of India can get an Aadhaar card. A resident is someone who stays in India for at least 182 days in the past 12 months. Most NRIs do not stay in India for that long, so they are not treated as residents. Because of this, Aadhaar is not required for them.

For PAN linking, the rule is also different. People living in India must link their PAN with Aadhaar, but NRIs who do not have Aadhaar are not forced to do this. They can continue using their PAN card normally.
For government benefits and subsidies, Aadhaar is needed only if someone wants to get schemes covered under Section 7 of the Aadhaar Act. NRIs who do not use these services do not have to link or apply for Aadhaar.
Overall, Aadhaar is optional for most NRIs unless they live in India for many months or want to use certain government services.
