It may happen that you have one or more roommates if you're living in a big city and are still in the beginning stages of your profession.  I lived with 3 flatmates when I first shifted to Bangalore for my first job. And what I understood from my stay with my first-ever flatmates is that whether you're moving in with friends or complete strangers, a roommate agreement will ensure that there won't be any arguments and that everyone is happy with their living situation. It is a good idea to have a roommate agreement because it specifies what is permitted and what is not, as well as who is in charge of making certain payments. A roommate agreement can spare you from having to cover the full cost of rent and utilities. But is a roommate agreement legally binding">Get your rent agreement drafted and delivered to your home through NoBroker, here.

Legally binding roommate agreement?

A roommate agreement is a distinct document from your rent agreement. The renters and the landlord or property management firm sign a lease or rent agreement. This agreement is a legal contract between you, your roommates (the tenants) and the landlord, and you both agree to pay the rent on time and abide by all other conditions.

But if one of the renters leaves, the landlord is not responsible for that. The rent will still be due from the remaining roommates, including their share for the now-absent roommate.

Your roommate agreement

This has nothing to do with the landlord. A written roommate agreement outlines all of the obligations of each roommate, from financial to personal. It should specify who will do what duties, who will prepare and share meals, quiet hours, overnight visitors, and whatever else you choose to include, as well as how the rent and utilities will be split.

The amount of rent, security deposit, and utilities that each renter is responsible for are the most important things to include, while there are many other vital things to add, in terms of legal issues.

So, is a roommate agreement legally binding?

Although your lease with the landlord is a legally binding contract from beginning to end, it's possible that a judge will only hold a tenant accountable for certain provisions if they violated a roommate agreement and are brought up in court.

If you sue your roommate, for instance, the court might order them to pay you back in full if they left you to pay their share of the rent and utilities after taking a job out of state. This may not be the case with failing to put the dishes away or playing too much house music during quiet hours.

Now you have the answer to is a roommate agreement legally binding or not.
