Hi. I would like to answer your query, is a residential car park private property in India or not. Yes, car parking is treated as private property, but it has some rules to it. If you consider car parking in an independent house, the space inside the premises for parking is indeed private. However, when it comes to parking for flats in the society premises, it comes under common areas. Let me throw more light on this below.


Residential Car Parking Rules


In India, car parking is considered to be a common area under Section 2(n) of the RERA Act. This section includes open parking spaces, basements and other shared spaces as common property. 

In the case of parking areas which come under the tag of common spaces, selling them separately is not allowed. 


Let me take you a little deeper into the rules related to car parking in societies. 


  1. Apartment residents who own any kind of vehicle are eligible for parking privileges. 

  2. There is a rule that only the specified number of vehicles to be parked in the designated spot. Suppose you own 2 cars and there is enough space for both of them to be parked in the spot. However, the society permits only 1 vehicle. In such a case, you’d need to seek permission from the Managing Committees to gain approval. This is all I have to share.
