If the builder delays construction and is unable to deliver the flat, the buyer can take legal action against the builder for delayed possession
. The buyer should write a complaint letter to the builder reminding him of the delay and demand for immediate delivery. If no response is received within a reasonable time then, it should be followed by a reminder. If there are some genuine reasons for the delay in completion, the builder can seek an extension in time. However, if the property is not delivered even after the extension period, there is a delay in delivery and/or possession of the property. However, the liability of the builder arises only when the delay is due to his own fault.
