Here is how to remove name from legal heir certificate;

  • Removing a name from a Legal Heir Certificate is possible in India, but it cannot be done online automatically or by simple request. 

  • Since a legal heir certificate is issued by a government authority (Tahsildar / Revenue Officer), any correction or removal requires official verification and legal grounds.

A name can be removed only if there is a valid and provable reason, such as:

  • The person is not a legal heir under applicable personal law

  • Wrong inclusion due to clerical or factual error

  • Existence of a registered will excluding that person

  • Legal heir predeceased the deceased

  • Relationship wrongly mentioned or misrepresented

Voluntary removal without reason is not permitted, as legal heirship is determined by law, not consent. 

  • Apply to the same authority that issued the certificate (usually Tahsildar/Revenue Department). 

  • Submit written application for correction/removal, copy of the original legal heir certificate, death certificate of the deceased, proof supporting removal (will, family tree, court order, affidavits, ID proofs).

  • The authority will review records and may issue notices to all existing legal heirs.

  • The Revenue Officer may conduct a local enquiry and invite objections from other heirs. If objections arise, the officer may pause the correction and ask parties to approach the court.

  • If there is a dispute among heirs, the only way to remove a name is by obtaining a declaratory order from a civil court. Once the court declares the correct legal heirs, the authority will issue a revised legal heir certificate based on the judgment.

  • If the authority is satisfied, the incorrect certificate is cancelled, and a fresh legal heir certificate with corrected names is issued.
