When you acquire land or property, the legal change in ownership takes place only when the land or property is registered under their name in the records of the government. If the value of the land you’re purchasing is more than Rs. 100, you are required to undergo land registration. And if the land registers in your name, then you are the legal owner of it.

The Registration Act, 1908 (Section 17) governs land and property registration in our country. You’re required to pay specific stamp duty and registration charges for this. Let me tell you how to register property with land registry:

Estimate the property value:

You have to make the estimation of the value of the property in your area to pay the stamp duty. The stamp duty value will be calculated as a percentage of: higher of the circle rate in your locality or the actual price paid for the property.

Prepare the Stamp Papers

: You will have to purchase non-judicial stamp papers equivalent to the stamp duty value. You can buy stamp papers from licensed stamp vendors or online.

Get the Sale deed Ready

: Prepare the sale deed and get it typed on the stamp papers. It is generally prepared by an authorized attorney on the buyer’s behalf. The subject on the sale deed varies on the transaction’s nature like a lease, sale, etc.

Pay Stamp Duty & Registration Charges Go to the Sub-Registrar’s Office:

Visit the sub registrar’s office along with two witnesses. All the parties involved in the process will have to keep their photographs and ID proofs handy. Along with the sale deed, you will have to submit the required documents, like a No Objection Certificate (NOC) of the society, property tax, property register card, and all other relevant property documents.

Completion of Registration

: After the verification of the documents, the sub-registrar will give you the original documents while maintaining a copy of the documents with them.
