Raising rent might seem easy, but trust me, it's not. I am a landlord myself and there are a lot of things that I need to consider before raising the rent of my tenants. Some important points have already been explained in the answers provided by the others. To learn how to raise rent on a tenant, you can read the other answers. However, I think every one of them has failed to provide the most basic steps. 

How to Increase Rent on Tenant?

As I mentioned above, there are a lot of things that need to be considered. But among all of that, the most basic thing to do is to explain to the tenant why the rent is increasing. As a landlord myself, I also ensure to explain to my tenants why the rent is increasing. 

For that, I call them first and see when they are available for a discussion. I meet up with them during that time and explain my reasons for increasing the rent. You might think that the tenant might vacate the premises after that, but that’s not the case.

There is a process on how to increase rent on a tenant that you must follow as a landlord. The inflation has let me, as an owner, raise the rent amount, but I did it only after consulting with an advocate friend. Owners can increase the rent amount, but for that, they need to inform the tenant at least 2-3 months before, make sure the hike amount is not exorbitant, and follow the rent hike rules of their respective state.

How to Raise Rent as a Landlord?

To raise the rent, a landlord must:

  • Sent a notice about the same to the tenant 2-3 months before. Landlords cannot simply raise the amount and evict a tenant if he or she fails to pay the amount. Tenants should be given time to come to terms with the landlord and decide whether they want to stay further or not.

  • The hike amount should be as per the rules of the state. For most states, there can be a hike of about 8% to 10%, so the landlords cannot exceed the maximum percentage.

  • The landlord should check the market rates and then increase the rent so that the rent seems justified.

  • The hike is okay, but the landlord needs to provide the tenant with proper reasons for the reason for doing so.

  • Lastly, a new rent agreement should be drafted mentioning the new rent and hike percentage.

How to raise rent on a tenant?

The tenant should be notified in advance about the rent increase. Landlords shouldn't increase the rent and expect a higher rent payment in the same monthly cycle. Landlords should notify the tenants thirty days in advance about the impending change. This will allow the tenant to decide whether they want to move out or pay the higher rent amount.

According to the laws, a landlord can increase ten percent rent after a remuneration cycle of two years. The Rent Control Act which was passed by the Government of India in 1948 has rules which are followed by people in Delhi, Maharashtra, Karnataka, etc. Details about tenancy rent increase have been given in the  Draft Model Tenancy Act which was launched in 2015. The price of things have been rising for a long time for which rents are also to be increased to cope up with the crisis. During covid we had made our rent 50% than what was expected as we knew that everyone was going through a crisis so such a burden should not be levied upon them. However, from January 2022, we were planning to increase the rent. My father did not know how to do it or what factors should be taken into consideration so he asked his friend,

Tenancy rent increase factors
  • The cause for increasing the rent, for us it was mainly due to cost of living expenses and also since the maintenance charge increased for us as well we had to increase the rent

  • Our tenant has been living here with his family for 5 years so we opted for a 5% increase of the rent fee. If you want to increase more, you need to tell as well as justify the reasons but it is better not to hike the rent too much or they will leave your house soon

  • Be sure that you are not violating the terms of the agreement when you are increasing the rent or they can file a case upon you for violating the terms of the agreement

  • Inform your tenant beforehand about the hike. We informed them about it on March that there will be a increase on their rent fee and that shall start from May
