You can give a Special Power of Attorney (SPA) while residing in one Indian state so that the agent can act in another state. But you must follow certain legal and procedural steps carefully to ensure the SPA is valid and enforceable. Here is how to give a special power of attorney from another state.

  • The SPA document should clearly name the “principal” (you, the person granting power) and the “agent/attorney in fact” (the person you are authorizing).

  • It must explicitly specify what powers you are granting (for example: to sell/transfer a property, to sign documents, to represent before authorities, etc.).

  • Include full details such as addresses, identity proofs, the property’s description (if the SPA concerns a property), and scope and duration of the powers.

  • The SPA should be executed on stamp paper of the value as required under the Stamp Act of the state where the SPA is being made. If the SPA involves immovable property (for example, land/house), the stamp duty amount can vary from state to state.

  • The principal (grantor) must sign, ideally, on every page of the SPA, and there must be at least two independent witnesses (not related to the principal/agent) signing.

  • After signing, the document should be notarized by a Notary Public. Notarization helps in authenticating the SPA, especially if it might be used across different states.

If the SPA relates to immovable property (e.g., sale or transfer of land/house), you must register it under the Registration Act, 1908, at the competent Sub-Registrar office, typically in the district where the property lies.
