You can obtain the title deeds for a property directly from the present owner or by seeking a certified copy at the local Sub-Registrar's Office (SRO). A title deed is the legal proof that you own a specific piece of property, land, house, flat, or plot. In India, this happens only when a sale deed (or gift/inheritance deed) is registered with the local Sub-Registrar’s Office under the Registration Act. 

When can I Not Get a Title Deed?

The registered document is your title deed and gives you real legal ownership rights. You can’t get a title deed if you haven’t legally acquired the property.

  1. If you are buying, execute a sale deed with the seller.

  2. If you are inheriting, execute the appropriate inheritance/gift/will deed.

  3. If it’s a transfer, you must have used the correct transfer document.

All deeds must clearly state what property, whose name, and how much is paid if it’s a sale. Otherwise, you won’t be able to get a title deed.

How can I Get Title Deeds of Property?

To make it a title deed, you must register the document where the property is located:

  1. Visit the local Sub-Registrar Office (SRO). Both the buyer (grantee) and the seller (grantor) must sign the deed in front of the official. You need two witnesses’ signatures.

  2. Pay stamp duty (varies by state, typically 5% to 7% of property value) and the registration fee (usually 1%). 

  3. After verification, the sub-registrar enters your deed into the official records. This becomes the title deed.

  4. Once registered, you can collect the deed physically from the SRO. Or in many states, download an official PDF from the state land records/registration portal (e.g., Kaveri in Karnataka).

You can request a Certified Copy from the same Sub-Registrar’s Office where it was registered:

  1. Fill the application form + ID proof.

  2. Provide deed registration number & year.

  3. Pay a nominal fee.

  4. The certified copy is issued in a few working days (3 to 7 days, typically). This certified copy holds full legal value.

How do I get a copy of my house title?

  • If you have lost your title deed the first thing you should do is that you should lodge a First Information Report (FIR). You need to provide details such as:

  • Document Registration Number

  • Owner' details

  • Collect the FIR and check the complaint number and signature and stamp of the police department carefully. If the police are unable to find the title deed they will issue a non-traceable certificate. 

  • You also need to post an advertisement stating that you have lost your title deed in a local and English newspaper as well. You need to wait for 30 days and if you do not receive any claims after 30 days you need to consult a lawyer and get a letter issued.

  • You need to prepare an affidavit stating that you have lost your document.

  • After this, you need to go to the sub-registrar's office along with other property documents. 

  • After the verification process, you will get your title deed.
