You must submit a petition to the local District Civil Court to get a Legal Heir Certificate through the legal system. A Legal Heir Certificate through a court is a judicially-recognised document establishing the rightful heirs of a deceased person, especially when there’s a dispute or government/revenue offices reject your application.

Unlike standard certificates from the Tehsildar/SDM office, a court-issued heir certificate carries legal weight and is often required in contested property or bank matters. I have shared the detailed steps on how to get legal heir certificate through court below.

How can I Get Legal Heir Certificate through Court?

  • You should approach the District Civil Court if:

    • Your application at the revenue/tehsil office has been rejected.

    • There’s disagreement among heirs.

    • A bank, court, or authority specifically asks for a court-issued legal heir certificate.

  • Gather key documents before filing a petition:

    • Death certificate of the deceased.

    • Identity & address proofs (Aadhaar, Voter ID, etc.).

    • Proof of relationship (birth/marriage/affidavit).

    • List and details of all possible heirs.

    • Any additional evidence supporting heirship.

  • Draft a petition for a legal heir certificate with the help of a lawyer. Submit it to the District Civil Court having jurisdiction over the deceased’s last residence.

  • Pay the court filing fees.

  • The court issues a notice to all listed heirs and potential claimants. Hearings are held. You must present evidence and witness testimonies.

  • Finally, the court verifies relationships and any objections. If satisfied, the judge passes an order declaring legal heirs. A certified copy of that order functions as a legal heir certificate.

Collect certified copies from the court registry. Also, court proceedings can take several weeks to several months, depending on case complexity and hearings required. Regular follow-up with your advocate helps avoid delays.
