If you’re a non-resident Indian (NRI) looking to sell property, you might need to apply for the lower/TDS exemption certificate via Form 13 under the Income Tax Act, 1961. Before I tell you how to file form 13 for NRI, let me tell you the documents required for that. You’ll need:

  1. Your PAN, a copy of your passport

  2. Buyer’s PAN and a copy of Aadhar

  3. Buyer’s TAN

  4. Acquisition documents of the property

  5. Bank statements showing advances received

  6. Your recent ITRs and Form 26AS

  7. Property sale agreement, sale deed, or builder allotment letter

  8. If someone is acting as your POA, their PAN/Aadhar and POA document.

Steps to File Form 13 for NRI

When you (the seller) are a non-resident (NRI/OCI/foreign citizen) selling immovable property in India, the buyer must deduct tax under Section 195. The standard TDS rate can be high and may exceed your actual tax liability. Applying for a certificate under Section 197 allows you to reduce that deduction. Here are the steps you can follow as an NRI to file Form 13.

  1. Log in to the income tax e-filing portal (if not already registered) and access the TRACES portal for TDS certificate issuance. 

  2. Submit Form 13 online with the jurisdictional certificate-issuing officer.

  3. Select the correct transaction type (property sale by non-resident).

  4. Fill in the sale value, cost of acquisition, expected capital gain, tax paid/estimated, etc. 

  5. Attach the required supporting documents. Submit and track your application.

  6. The jurisdictional TDS certificate officer reviews your application. They may raise queries or ask for further information. You’ll need to respond promptly. 

Processing time may vary (typically 2-4 weeks). Once the certificate is issued, send a copy to the buyer. The buyer then deducts TDS at the rate specified in the certificate rather than the standard higher rate.
