DTAA stands for

Double Taxation Avoidance Agreement. It is an agreement that is executed between two countries to mitigate tax and also promote economic growth and investment between them. I have seen a lot of people with the query-

how to claim DTAA benefit in India. So let me share the methods and also the documents needed for the same.

An NRI can claim benefits under DTAA by filling out Form no 10. You can visit incometaxindia portal that is-

https://incometaxindia.gov.in/pages/international-taxation/dtaa.aspx

Fill in necessary details like your nationality, Tax Identification Number, address and more

 

If you are a new applicant, visit your bank

or the Income Tax Department

with submit some documents

like-

  1. Tax Residency Certificate (TRC) obtained from the Government of the home country

  2. Self-attested copy of Passport and Visa

  3. Indemnity-cum-declaration 

  4. OCI card (if needed)

  5. Self-attested copy of PAN Card (if needed)

And get it done with the help of the officials there.

So if you were doubting is TRC of us mandatory for claiming DTAA in India, know that it is. Some mandatory details that need to be mentioned in the TRC are-

  1. Name of the assessee

  2. Status (individual, company, firm etc.) of the assessee

  3. Nationality of the assessee

  4. Assessee’s tax identification number 

  5. Period for which the residential status as mentioned in TRC is applicable

  6. Address of the applicant (outside India) for the period for which TRC is applicable

W 8BEN is a form that is used by foreign persons to claim exemption status from some particular withholdings. So yes, you can claim DTAA through it in India.
