First, check if the POA was registered with the Sub-Registrar’s office. Registered property POAs (especially for sale or transfer) must be cancelled through a registered cancellation deed. If it was not registered, a notarised revocation document is sufficient.
Prepare a clear Cancellation or Revocation Deed stating: Your name (principal) and the agent’s name, Details of the original POA (date, parties, registration number if any), A clear statement that all powers granted are revoked from a specific date.
Sign this in the presence of two adult independent witnesses.
If the original POA was registered, take the Revocation Deed to the same Sub-Registrar’s office where it was recorded and complete the registration. This makes the cancellation legally binding and public.
Send the registered (or notarised) revocation to the former agent by registered post with acknowledgment to ensure they receive it. This is critical until they’re notified, they could possibly act on the POA.
Inform banks, government offices, registrars, tenants, and any parties who previously dealt with the agent under the old POA. You can also publish a public notice in a local newspaper to warn the public that the POA is cancelled.
If the agent continues acting despite revocation, file a civil suit or seek court injunctions. Courts support cancellation where the agent exceeds authority or the principal clearly revoked their power.
