Summary
POAs include: General POA for broad authority in finances, property, or legal matters; Special POA for specific tasks with limited duration; Durable POA, valid even if the principal becomes incapacitated; Springing POA, effective on a specific condition; Medical POA for healthcare decisions; and NRI POA for Non-Resident Indians to manage affairs in India.

There are several recognised types of POA;

  1. General POA: This grants broad authority to the agent to act on behalf of the principal in various matters, including property transactions, financial dealings, legal decisions, banking, and business operations. It is usually used when the principal is unavailable or unable to manage affairs temporarily.

  2. Special POA: Also called a specific POA, this type limits the agent’s authority to particular acts or transactions for example, selling a specific property, handling a bank matter, or appearing in a court case. It ends automatically once the specific task is completed. This POA remains valid for a defined time period only, such as when the principal is abroad during a specific period or for one project. Once the period expires, it automatically ceases.

  3. Durable POA: A durable POA continues to remain effective even if the principal becomes mentally or physically incapacitated. This makes it valuable for long-term planning, especially for elderly or vulnerable individuals.

  4. Springing POA: This type only “springs” into effect on a specified condition usually when the principal becomes incapacitated as certified by a doctor. Until that event, the agent has no authority.

  5. Medical POA: This POA empowers the agent to make medical and healthcare decisions on behalf of the principal if they are unable to make those decisions themselves.

  6. NRI POA: For Non-Resident Indians, a tailored POA allows an agent in India to manage property, banking, or legal matters on their behalf.

I hope this helps!
