A Lasting Power of Attorney (LPA) remains valid indefinitely. Once it is registered there’s no fixed expiration date built into the document. The LPA continues to give your appointed attorney legal authority to act on your behalf as long as the donor is alive and competent or until one of the specific ending conditions occurs.
The most definitive end point is when the person who made the LPA (the donor) dies. At that moment all authority under the LPA automatically ceases.
The donor can revoke or cancel the LPA at any time while they still have mental capacity. After revocation, the LPA immediately stops being valid.
An LPA can also end if the attorney dies and no replacement is named, or if a court cancels it due to misuse or legal concerns.
Once registered, it can be used immediately (with the donor’s permission) and continues indefinitely until one of the ending conditions above happens. This type also lasts indefinitely once registered, but normally only takes effect when the donor loses mental capacity.
For instance, if the Court of Protection dismisses your lawyer because they are not serving the interests of the person who assigned them. In this case, the lasting power of attorney will end automatically.
Basically, a Lasting Power of Attorney doesn’t have a built-in expiry date. If it’s properly made and registered, it lasts until the donor’s death, revocation, or another legal ending event. This makes it a lasting safeguard for your decisions and wellbeing.
You can revoke a POA if you believe your agent isn't the person you want in charge or if you just don't think you need one anymore. You might have to make a new one with the new agent's name for that. This is all about how long does lasting power of attorney last.
