How to Calculate Stamp Duty on Rental Agreement?
It is calculated as a percentage of the average annual rent multiplied by a duration-based factor.
For agreements up to one year, stamp duty is 2% of the annual rent.
If the lease exceeds one year, you multiply the average annual rent by a factor based on the lease term three times for 1 to 5 years, four times for 5 to 10 years, five times for 10 to 20 years, and six times for leases beyond 20 years. Then apply the 2% rate on this total.
For instance, a 3-year agreement with an average annual rent of Rs 2 lakh involves calculating stamp duty on Rs 6 lakh (Rs 2 lakh × 3) at 2%, totaling Rs 12,000. After paying stamp duty, there’s an additional registration fee, typically set at 1% of annual rent plus security deposit in cities like Lucknow.
