Recently, my neighbour’s relative asked me about the method of taking over someone’s apartment lease. After researching a bit, I came to know, it involves a clear, step-by-step approach to ensure legal validity and smooth transfer.

  • First, understand the lease type. Review the existing rental agreement to check if sub-letting or lease transfer (assignment) is permitted under its terms and under Section 105 of the Transfer of Property Act (1882), which allows assignment unless explicitly prohibited.

  • Next, get written permission from the landlord. This is essential, as without it, the takeover isn’t valid. 

  • In parallel, the new tenant should complete the standard application process, including background and financial checks.

  • Once approved, draft a formal lease takeover agreement (also known as an assignment of lease) that includes rent details, duration remaining, date of transfer, and acknowledgement that the landlord consents to this change.

  • It’s also important to verify the original agreement’s terms to ensure you understand all obligations, from maintenance duties to rent escalation clauses. 

  • Inspect the property for its current condition and discuss whether cleaning or minor repairs will be handled before you move in.

  • After drafting and mutual agreement, both the outgoing tenant and you sign the takeover document, and the landlord countersigns to formalize the transfer.

  • Finally, notify building management or co-operative bodies, if applicable, updating tenancy records to reflect the new occupant.
