It can be a difficult task to own property in India while residing outside, but the procedure goes smoothly with the correct planning. So how can NRI register property in India? NRIs can successfully register property in India without being physically present. Selecting a residential or commercial property is the first step in the property registration process for non-resident Indians (NRIs) in India. They must avoid restricted categories such as agricultural land unless they have special authorisation.

Can NRIs Register Property from Abroad?

  1. For this firstly, as an NRI, you must hire a lawyer to assist you with the legal checks, and ensure that the property has a clean title, approved plans, and encumbrance-free status.

  2. Suppose an NRI is not in India in person. If that is the case, they can give a Power of Attorney (POA) to a reliable person to manage the property registration process on their behalf. The POA needs to be registered with the Indian Embassy or Consulate of the nation where the non-resident Indian lives.

  3. Pay the registration fees and stamp duties, and execute on non-judicial stamp paper.

  4. Obtain a completion certificate.

This is the NRI’s property registration process. As an NRI, you can avail Section 80C deductions and follow capital gains tax norms.
