I was about to seal the property deal when I found out that the seller did not have all the property papers. He told me that the property documents were misplaced by their banker. File an FIR as soon as you find out that certain documents are missing, lost, or stolen.
Next, publish an ad in a regional newspaper and in an English daily newspaper about the loss of property papers. I advise you to wait for the next 15 days to see if anyone finds them and returns them.
Now, file an application for a share certificate from the housing society. Also, ask for a No-objection certificate from them.
Prepare an undertaking on stamp paper about the missing property papers along with the police complaint no. and the advertisement text and get them attested and registered with the notary.
Deposit all the above-mentioned documents to the registrar’s office, pay the required fees and get the duplicate copy of the sale deed.
