In India, if a flat is owned by a husband and he has nominated his wife, then after his death, the wife becomes the legal heir of the property . However, if the husband has left behind any other legal heirs, such as a son, then they may also have a claim to the property.
If the wife wishes to transfer the flat in her name, she will need to obtain a succession certificate from a court of law . The succession certificate will establish her as the legal heir of the property and enable her to transfer the flat in her name.
