Tenant’s Liability:

  1.  Registered Businesses: Must pay GST if the landlord is unregistered, under Reverse Charge Mechanism (RCM).

  2. Unregistered Tenants: No GST payable unless voluntarily registered.

GST applies only if aggregate rent exceeds Rs. 20 lakhs/year (Rs. 10 lakhs in special category states). No GST on residential rent, even for businesses (e.g., employee accommodations).

Who Pays GST?

  1. Landlord: If registered, collects GST from the tenant.

  2. Tenant: Pays under RCM if the landlord is unregistered (must be GST-registered).

Example: A company renting office space (Rs. 50,000/month) pays 18% GST (Rs. 9,000/month) if the landlord is registered.
