For almost a decade, our uncle’s home has been empty. My father, therefore, wanted to rent it out and wanted some good tenants to take care of it. He asked his lawyer friend- "Can I rent a house for someone else?” It was then that we learned that renting a house is not easy, especially if it is someone else’s property. You can be the owner’s spouse, friend, relative, and more, but in order to rent it out legally, you will need to have the legal right. Let me share more details about this topic here.

Can you rent a house for someone else?

The answer to this question is both yes and no. You cannot rent someone else’s property unless you have the notarized Power of Attorney or a valid title of the property.

A Power of Attorney is a legal document that appoints another person to organise or manage the actual owner’s property. To get the Power of Attorney, you will have to visit the

notary or sub-registrar’s office along with all the property documents and 2 witnesses. You can also get the Title of the Property and establish your lawful ownership of the property and then rent it out. Without these two, renting someone else’s property is not possible.

What are the precautions that an owner should take before renting a property?

Before renting a property to a tenant

  • A legal rent agreement having both parties' details must be drafted

  • The rent agreement must be registered

  • Tenenat’s police verification is to be conducted

These are the three main precautions or factors that an owner must consider before renting a property.

I hope you have understood
