RERA and NCLT or National Company Law Tribunal has been initiated to address the issues against any real taste builder. Previously several properties used to get sold illegally but now, due to such initiations, the illegal buy or sale of properties has almost stopped. When can the flat buyer go now to NCLT?

The buyers can go to the NCLT if the builder delays or fails to give possession of the promised apartment. But one thing is to be kept in mind. The grievance must be filed by a group of 100 buyers or 10% of buyers in a project. So the answer to can home buyers approach NCLT is yes but this number is to be maintained. 

  Can anyone appeal against NCLT?

If a buyer is not happy with the decision of the NCLT, he/she can appeal to the Supreme Court. You can consider the NCLT as High Court as the jurisdiction previously vested in High Courts has now been given to NCLT. So if one is unhappy with the High Court or NCLT’s order, they can appeal in Supreme Court.

 

So NCLT for home buyers is definitely helpful to resolve disputes between a real estate builder and a buyer.
