I do not think this is right on his end to construct a room in the cellar area. The National Building Code states that the only permitted uses for basements/ cellar areas are for businesses, storage, parking, or areas where air conditioning equipment can be installed. Although many people rent out this room for dwelling purposes, doing so is against the law. In actuality, it is against the construction ordinances to use the basement as a kitchen or bathroom.
However, you can take legal advice from a property lawyer to get a proper solution regarding the same.
