Would you like to know can a tenant withhold rent for repairs? The tenants may withhold rent if the landlord fails to make needed repairs, but only under certain conditions;

  • First, the major repairs and landlord duties. Landlords must maintain the property so that it is habitable. That includes keeping structural elements safe, ensuring plumbing, electrical, heating, ventilation, and sanitary systems work properly, removing infestations, and generally making sure occupancy standards are met. If any of these are neglected, a landlord is failing their duty.

  • If the landlord refuses or delays required repairs, a tenant may have the option to withhold rent after giving proper notice. 

  • However, you can’t always withhold rent. Whether it's legal depends on the lease agreement itself, and whether you’ve given the landlord proper written notice.

If your landlord has failed to perform essential repairs (e.g. electrical hazards, leaking roof, unsafe plumbing), and you’ve notified them and given them time, you may be justified in withholding rent. But you should possibly seek legal advice before doing so.

I informed him that regardless of whether the landlord does maintenance or repairs, tenants are still obligated to pay rent on time under the Rent Control Act and normal rental agreements. I have shared a few points here you must know.

  • The landlord is typically responsible for major repairs related to the structure, plumbing, electrical systems, etc.

  • Tenants do not have the automatic right to withhold rent if repairs are not done. The rent must be paid on time, as failure to do so could lead to eviction proceedings or legal action for non-payment.

  • Where the property is uninhabitable or there is a significant defect that affects the tenant’s health and safety (e.g., a broken roof, or unsafe wiring), tenants may have legal grounds to request immediate repairs. Tenants may refuse to pay rent for repairs in these circumstances.

  • Tenants may protest to the Consumer Forum about the landlord's failure to uphold the implicit duty to keep the property in livable shape if the landlord doesn't make repairs that impact the property's habitability.

If the agreement specifies that the tenant has to do minor repairs (e.g., fixing taps, light bulbs), they are expected to fulfill this obligation.
