A property manager whether appointed under a property management agreement or as an agent is fundamentally empowered to handle routine tasks. So, can a property manager represent a landlord in court? Is it Possible for a Property Manager to Represent a Landlord in Court?
Under Indian law, particularly the Indian Contract Act, 1872, such an agency relationship allows the agent to act on behalf of the principal to the extent of the authority granted, and such authority must be explicitly agreed upon. However, when eviction or other landlord–tenant disputes escalate to courtroom proceedings, the rules change.
As per the CPC (Code of Civil Procedure), only a recognised pleader (i.e., a licensed advocate) or a recognised agent can appear for the parties in court; typically, property managers do not qualify as recognised agents under Indian law unless very specific formalities are met.
In practice, if the tenant contests eviction or a dispute arises, Indian courts expect a qualified lawyer to represent the property owner.
Thus, while the property manager can prepare documents, serve notices, and manage procedural steps in uncontested cases, the actual appearance in court and conduct of litigation must be handled by a legal professional.
The manager may, of course, appear as a witness providing factual testimony before the court regarding documentation or tenant behavior but cannot legally represent the owner as a pleader.
