I got confused when I planned to rent out my new property. The very first question that came to my mind was, can a landlord ask for 12 months rent in advance? I asked my friend, a legal expert, about it, and he said a landlord can ask for 12 months’ rent advance as a security deposit in Karnataka, but there are usually legal restrictions. Can Landlords Ask for 12 Months Rent as a Security Deposit?

No. Unless both landlord and tenant agree, landlords are not allowed to legally demand a full year's rent in advance in the majority of India. Although it's typical for landlords in Karnataka to demand a huge advance rent, the law places a cap on this sum. 

  1. For residential properties, landlords in Karnataka are legally permitted to demand an advance payment of no more than two months' rent.

  2. Landlords usually demand six to twelve months' rent in advance in Bangalore, but this isn't an accepted legal requirement.
