If the property is an Ancestral property, i.e., it has been inherited by at least four generations, the property can not be sold without the permission of all the legal heirs.
If the property is self-acquired, and the joint owners mutually decide to sell out the property but all the documents of all the owners are required.
Therefore, as per my understanding of this case, the flat can be sold after issuing the NOC by all the legal heirs.
