Hey,
As per my knowledge, the builder can deliver possession of the apartment to the buyer only after receiving the occupancy certificate from the concerned authority. The builder can start taking the maintenance charges after you take possession of the apartment. If the building is asking you to pay the maintenance charges without OC, then you can approach consumer court or RERA.
