I bought a B-Khata commercial corner site measuring 4500 Sq.Ft in Attur layout in Aug.1995 (presently Thirumallappa layout D Block, Yelahanka,Bangalore) consisting 132 sites (sold during 1995-98), Registered Sale Deed, Khata name was changed to my name by Yelahanka Municipal Council, having EC continuously for more than 25 years, up-to-date tax paid, All facilities such as asphalted roads, electricity, water provided by BBMP. But our vendor secretly pledged 26 sites, including my site, by colluding with a pvt bank, and intentionally became defaulter resulting in Auction & sold by bank to a realtor illegally in the year 2011. He has filed a OS against three legally purchased site owners, in civil court, seeking permanent injunction, which is still pending in the court. I am having all ownership documents, having physical possession by constructing a shop and rented out since 2012. My question is whether I can sell my site at the present situation. Incidentally my site is located out of the boundary claimed by the bank. My documents are lean, intact and having all relevant records proving the ownership of the Site.
