I was staying in a Pagdi building and was forced to vacate by MCGM in the ‘Lockdown’ time. It was demolished by MCGM in the month of December ’21. A developer got the conveyance in his name in Dec. ’21 but, the property is ‘Conditionally’ in his name. He is asking us to ‘accept’ whatever he is offering in leu of the flat. I used to own the old building since the year 2000, he put me again on Pagdi (Tenancy) category and go ahead with the redevelopment of the premises! Can he do it? Does the construction/plan of “Tenancy Building” permitted in current state of the law? Who is the final authority to accept or reject the developer’s application for the same i.e. put the tenants who are not ready to accept his offer? Because some of the tenants have accepted because he gave them a good deal so, some of the flat will be on ownership basis and some on ‘Pagdi’ ; now, is it possible to have some flat of a newly constructed building on ownership and some on ‘Pagdi’? Who would be the ‘Landlord’ of the ‘Pagdi’ flats?
