Sale Agreement
A sale deed of a flat in Maharashtra mentions the husband and wife as joint purchasers of the flat, no other special wording for co-tenancy has been mentioned in the deed. They have got the property registered together at the same time in both of their names with the Registrar. Now, one of the owners that is the husband, my Papa unfortunately passed away without a will, now will the entire flat rights be automatically transferred to the other owner that is my mom? Is she authorised to sell that flat without any complications or any legal action against her? I read on your site that, automatically all rights are transferred but here municipal corporation officers and lawyers are telling me to go to the district court and apply for a legal heir certificate. What is correct? All other assets have been easily got transferred without a legal heir certificate. Please suggest. Thanks in advance. Is there any economical alternative to get this done?
